1. Purpose
These General Terms and Conditions of Sale (hereinafter "T&Cs") govern all sales of eSIM mobile data plans (hereinafter "Plans") and associated services made by the company SASU WassaSim (hereinafter "WassaSim" or "the Seller") to consumers (hereinafter "the Customer" or "the Buyer") via the WassaSim mobile application and the website wassasim.com (hereinafter "the Application").
The Plans constitute digital content not supplied on a tangible medium within the meaning of Article L221-28 13° of the French Consumer Code.
2. Acceptance of the T&Cs
In accordance with Article L111-1 of the French Consumer Code, the Customer acknowledges having read these T&Cs before placing their order.
Placing an order implies full and complete acceptance of these T&Cs. The Customer acknowledges having the legal capacity to enter into a contract.
WassaSim reserves the right to modify these T&Cs at any time. The applicable T&Cs are those in force on the date of the order.
3. Description of the service
WassaSim is a marketplace for eSIM mobile data plans. The service allows the Customer to:
- purchase a mobile data plan for themselves or for a third party (relative, family member, colleague);
- receive an eSIM profile in the form of a QR code, which can be activated on any compatible device;
- choose from plans covering different countries and data volumes;
- optionally subscribe to a virtual private network (VPN) service as a complement to the Plan (see article 15).
Plans are provided by international partner operators. WassaSim acts as a reseller of these plans.
4. Purchase on behalf of a third party
The Customer may purchase a Plan on behalf of a third party (hereinafter "the Beneficiary"). In this case:
- the Customer remains the sole contracting party with WassaSim and assumes all obligations arising from these T&Cs;
- the Customer warrants having obtained the Beneficiary's consent for the reception and installation of the eSIM profile;
- the Customer is responsible for the accuracy of the Beneficiary's contact details provided during the order;
- rights relating to the legal guarantee of conformity and after-sales service are exercised by the Customer;
- WassaSim shall not be held liable in the event of the Beneficiary's refusal to install the eSIM profile or incompatibility of the Beneficiary's device.
5. Ordering without account creation (guest checkout)
5.1 Principles
The Service allows the Customer to place an order without creating a user account. In this case:
- the Customer provides their email address, which serves as the identifier for the order;
- a unique and confidential access token is generated for each order, allowing the Customer to check the status of their order and access their QR code;
- the Customer is responsible for keeping this access token.
5.2 Limitations
Without a user account, the Customer cannot view the history of their previous orders or track the data consumption of their active Plans from the Application.
5.3 Account creation
The Customer may create an account at any time via a login link sent by email (magic link). Orders placed in guest mode are not retroactively linked to the account created.
6. Prices and payment methods
6.1 Prices
Plan prices are displayed in euros, inclusive of all taxes (TTC), and include the applicable value-added tax (VAT).
The VAT rate applied depends on the Buyer's country of residence, in accordance with Article 58 of VAT Directive 2006/112/EC relating to electronically supplied services:
- Buyer residing in France: French VAT at the current rate (20% as of January 1, 2026).
- Buyer residing in another EU Member State: VAT at the standard rate of the Buyer's country of residence, in accordance with the One Stop Shop (OSS) scheme.
- Buyer residing outside the European Union: VAT exemption (Article 259 B of the French General Tax Code).
The Buyer's country of residence is determined from their IP address, in accordance with EU Implementing Regulation 282/2011 (Article 24b).
The breakdown of the price excluding tax (HT), the VAT amount, and the rate applied is shown in the order summary before payment validation.
WassaSim reserves the right to modify its prices at any time. Plans are invoiced based on the prices in effect at the time of order validation.
6.2 Payment methods
Payment is made in full at the time of the order, using one of the following methods:
- Credit/debit card (Visa, Mastercard, etc.)
- Google Pay
- Apple Pay
Payment processing is handled by Stripe, Inc., a PCI-DSS certified payment service provider. WassaSim does not store any of the Customer's banking data.
6.3 Payment security
All transactions are secured by the encryption protocol implemented by Stripe. The Customer may be subject to strong authentication (3D Secure) in accordance with the European PSD2 regulation.
7. Promotional codes and discount coupons
7.1 Terms of use
Promotional codes are subject to the following conditions:
- only one promotional code may be used per order;
- codes cannot be combined with each other, unless otherwise stated;
- codes have a limited validity period, indicated at the time of issuance;
- codes are neither transferable nor exchangeable for money;
- WassaSim reserves the right to cancel any order using a code fraudulently or in violation of the code's terms of use.
7.2 Compensation codes
In the event of a Plan provisioning failure, WassaSim may issue a compensation code for the benefit of the Customer. This code is personal, linked to the Customer's email address, and valid for 90 days.
7.3 Referral codes
Referral codes entitle the holder to a fixed discount on the next order. A Customer may not use their own referral code. WassaSim reserves the right to modify or discontinue the referral program at any time, without retroactive effect on codes already issued.
8. Order process
The order process is as follows:
- Destination country selection: the Customer chooses the country in which the plan will be used.
- Plan selection: the Customer selects the desired data volume from the plans available for the chosen country.
- Recipient selection: the Customer indicates whether they are purchasing the plan for themselves or for a third party.
- Delivery method selection: the Customer chooses to receive the QR code by email or to share it themselves via their device's native sharing system.
- Information entry: the Customer provides the necessary information (recipient's email address if applicable).
- Summary and validation: the Customer reviews the order summary, reads the T&Cs, and validates the order by proceeding with payment.
In accordance with Article L221-28 13° of the French Consumer Code, before final order validation, the Customer is informed and expressly agrees that:
- delivery of the digital content begins immediately after payment confirmation;
- they expressly waive their right of withdrawal.
The order is final only after payment confirmation by Stripe.
WassaSim reserves the right to refuse any order for legitimate reasons, including suspected fraud, abnormally large orders, or Customer account suspension.
9. Delivery of digital content
9.1 Delivery methods
The Plan is delivered in the form of a QR code containing the eSIM profile. Delivery is made according to the method chosen by the Customer:
- By email: the QR code is sent to the email address provided by the Customer during the order, via the Resend service (noreply@wassasim.com). Delivery is deemed effective upon sending of the email by WassaSim.
- By native sharing: the QR code is displayed in the Application. Delivery is deemed effective upon display of the QR code in the Application. It is the Customer's responsibility to transmit the QR code to the Beneficiary by the means of their choice. WassaSim shall not be held liable for any failure of transmission by the Customer to the Beneficiary.
9.2 Delivery times
The QR code is delivered within minutes of payment confirmation. This time may vary depending on the provisioning time by the partner operator.
In case of abnormal delay (beyond 30 minutes), the Customer is invited to contact customer service at contact@wassasim.com.
9.3 Order tracking
Each order has a unique access token allowing the Customer to check the status of their order and access their QR code.
9.4 Incorrect contact details
If the Customer enters an incorrect email address during the order, the QR code is sent to the address provided and delivery is deemed effective. WassaSim shall not be held liable for an incorrect email address provided by the Customer and no refund shall be granted on this basis.
The Customer may contact customer service (contact@wassasim.com) to request the QR code be resent to the correct address, subject to identity verification. Such resending constitutes a goodwill gesture and not a contractual obligation.
10. Plan validity and duration
10.1 Validity period
Each Plan has a validity period indicated on the product page at the time of purchase (expressed in days). The validity period begins from the first connection to the mobile network with the activated eSIM profile.
10.2 Expiration
Upon expiration of the validity period, the Plan is automatically deactivated. Unconsumed data is lost and does not entitle the Customer to any refund, carryover, or compensation.
10.3 Non-transferability
A provisioned eSIM profile is linked to the device on which it is installed. It cannot be transferred, resold, or reinstalled on another device once activated. Deletion of the eSIM profile from the device is permanent and does not entitle the Customer to any replacement.
11. Right of withdrawal
11.1 Exclusion principle
In accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a tangible medium, the performance of which has begun with the consumer's prior express consent and express waiver of the right of withdrawal.
The Customer acknowledges and expressly agrees, before order validation, that:
- the Plan constitutes digital content not supplied on a tangible medium (eSIM profile delivered as a QR code);
- performance of the contract begins immediately after payment confirmation, through provisioning of the eSIM profile with the partner operator;
- they expressly waive their right of withdrawal for this order.
This waiver is obtained through a checkbox or equivalent mechanism in the Application, before final order validation.
11.2 Exceptions
In case of delivery failure (QR code not received) or proven non-conformity of the Plan (technical inability to activate the eSIM profile), the Customer may obtain a refund under the conditions provided in Articles 12 and 13 of these T&Cs.
12. Legal guarantee of conformity (digital content)
12.1 Legal guarantee
In accordance with Articles L224-25-12 and following of the French Consumer Code, WassaSim is required to deliver digital content that conforms to the contract and is liable for defects in conformity existing at the time of delivery.
The digital content conforms to the contract if it meets the following criteria:
- it corresponds to the description, type, quantity and quality provided for in the contract (coverage country, data volume, validity period);
- it is fit for the purpose normally expected of digital content of the same type;
- it is provided with all accessories and instructions provided for in the contract.
12.2 Implementation of the guarantee
In case of a conformity defect, the Customer may request the Plan be brought into conformity or, failing that, a price reduction or contract termination, under the conditions provided by the Consumer Code.
The Customer must report any conformity defect to WassaSim within a reasonable time of discovering it, at contact@wassasim.com.
12.3 Refund
In case of a refund, it will be made via Stripe to the payment method used for the order, within 14 days of the refund decision. Payment processing fees are not refunded.
13. Liability
13.1 WassaSim's obligations
WassaSim undertakes to:
- provide Plans that conform to the description presented in the Application;
- ensure delivery of the QR code as promptly as possible;
- process complaints within a reasonable time.
WassaSim's liability under these T&Cs is limited to the amount of the order concerned.
13.2 Limitations of liability
WassaSim shall not be held liable for:
- malfunctions related to the Customer's or Beneficiary's device (eSIM incompatibility, carrier lock, network settings);
- the quality of the mobile network in the destination country, which depends on the local operators partnered with the eSIM operator;
- errors made by the Customer when entering their information (incorrect email, wrong country selection);
- service interruptions due to force majeure within the meaning of Article 1218 of the French Civil Code;
- indirect damages (data loss, loss of profit, commercial harm);
- use of the Plan or VPN service for unlawful purposes by the Customer or Beneficiary;
- restrictions imposed by third-party services (VPN blocking, content geo-restrictions).
13.3 Customer's liability
The Customer is responsible for:
- verifying the eSIM compatibility of the recipient device before purchase;
- the accuracy of the information provided during the order;
- installing and activating the eSIM profile on the recipient device;
- keeping the access token for order tracking;
- using the Service in compliance with applicable laws.
14. eSIM compatibility (information obligation)
14.1 Prior information
In accordance with its prior information obligation (Article L111-1 of the French Consumer Code), WassaSim informs the Customer that:
- Plans can only be used on devices compatible with eSIM technology;
- not all mobile devices are eSIM compatible;
- some eSIM-compatible devices may be carrier-locked and may not accept third-party eSIM profiles;
- Plans provide mobile data access (internet) only and do not include a phone number, voice calls, or SMS;
- the Application offers a compatibility checking tool, which the Customer is encouraged to use before any purchase.
14.2 Customer's responsibility
It is the Customer's responsibility to verify, before placing any order, that the device on which the eSIM profile will be installed is compatible and unlocked. WassaSim shall not be held liable for a purchase made for an incompatible device.
15. VPN service (optional add-on)
15.1 Description
WassaSim offers a virtual private network (VPN) service as a complement to eSIM Plans. This service allows the Customer to browse via a French IP address using the WireGuard protocol.
15.2 Characteristics
- The VPN is an ancillary service linked to the duration of the associated eSIM Plan. Upon expiration of the Plan, VPN access is automatically deactivated.
- The VPN is strictly personal and may not be shared, resold, or transferred to a third party.
- WassaSim operates a no-log policy: no traffic or connection logs are retained.
- Throughput and availability of the VPN depend on the quality of the Customer's connection and server load.
15.3 Permitted use
The Customer agrees to use the VPN in compliance with applicable laws. The following are prohibited:
- using the VPN to circumvent legal restrictions;
- any unlawful activity via the VPN (fraud, hacking, identity theft, illegal downloading);
- abusive use of bandwidth (mass downloading, cryptocurrency mining, server hosting).
In case of violation, WassaSim reserves the right to suspend or terminate VPN access without notice or compensation.
15.4 Liability
WassaSim does not guarantee that the VPN will provide access to all online services. Some third-party services may block VPN connections. WassaSim shall not be held liable for such restrictions or for consequences arising from the Customer's use of the VPN.
16. Personal data protection
16.1 Data collected
As part of the order process, WassaSim collects only the data strictly necessary for the performance of the contract:
- email address (for QR code delivery and order tracking);
- payment data (processed exclusively by Stripe, not stored by WassaSim).
16.2 Data controller
The data controller is the company SASU WassaSim, contactable at contact@wassasim.com.
16.3 Privacy policy
For more information on the processing of personal data, the Customer is invited to consult the Privacy Policy accessible from the Application.
16.4 Customer's rights
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has rights of access, rectification, erasure, portability and objection regarding their personal data, exercisable by email at contact@wassasim.com.
17. Intellectual property
All elements of the Application and the website wassasim.com (text, images, graphics, logo, icons, software, database) are the exclusive property of SASU WassaSim or its partners and are protected by French and international intellectual property laws.
Any reproduction, representation, modification, publication or redistribution, in whole or in part, of the content of the Application or website, by any means, is prohibited without the prior written authorization of WassaSim.
The WassaSim brand, logo and associated graphic elements are the property of SASU WassaSim. Any unauthorized use constitutes counterfeiting sanctioned by Articles L.335-2 and following of the French Intellectual Property Code.
18. Complaints and customer service
For any complaint or question regarding an order, the Customer may contact WassaSim:

WassaSim undertakes to acknowledge receipt of any complaint within 48 business hours and to provide a response within a reasonable time.
19. Dispute resolution
19.1 Amicable settlement
In case of a dispute, the Customer is invited to contact WassaSim first in order to seek an amicable solution.
19.2 Consumer mediation
In accordance with Articles L611-1 and following of the French Consumer Code, the Customer may have recourse free of charge to a consumer mediator in case of an unresolved dispute:

The Customer may also file a complaint on the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
19.3 Time limit for referral
The Customer has one year from their written complaint to WassaSim to refer the matter to the mediator.
20. Applicable law and jurisdiction
These T&Cs are governed by French law.
In case of a dispute and failing amicable resolution or mediation, the competent French courts shall be those of the consumer's place of domicile, in accordance with the applicable rules of territorial jurisdiction, or, at the Customer's choice, the court of the location of WassaSim's registered office.
21. Proof archival
In accordance with Article 1127-1 of the French Civil Code, WassaSim archives order confirmations and invoices on a reliable and durable medium constituting a faithful copy. WassaSim's computerized records shall be considered as proof of communications, orders, payments and transactions between the parties.
Billing data is retained for a period of ten (10) years from the date of the order, in accordance with applicable accounting and tax obligations.
22. Assignment of contract
WassaSim reserves the right to assign or transfer the rights and obligations arising from these T&Cs to any affiliated company or successor, particularly in the event of merger, acquisition, demerger or asset transfer, without such assignment modifying the Customer's rights under these T&Cs.
The Customer may not assign their rights and obligations under these T&Cs without the prior written consent of WassaSim.
23. General provisions
23.1 Severability
If any clause of these T&Cs is declared null or unenforceable by a court decision, such nullity shall not affect the validity of the other clauses, which shall remain fully applicable.
23.2 Tolerance
The failure of WassaSim to enforce any of the Customer's obligations under these T&Cs shall not be construed as a waiver of the obligation in question.
23.3 Entirety
These T&Cs constitute the entire agreement between WassaSim and the Customer regarding the use of the Service and supersede any prior agreement on the same subject.
